Terms of Service

The guidelines for using blushandcherish.com and booking photography services with Blush & Cherish.

By using blushandcherish.com, submitting an inquiry, or booking a session, you agree to these Terms. If booking on behalf of a minor, you confirm you are their parent/guardian or have legal authority.

Booking, Payments & Invoicing

- A session fee stated on your invoice/contract is required to reserve a date; fees are non-refundable but may be applied to a rescheduled date per the policy below.

- Remaining balances are due as stated in your invoice/contract and must be paid before session completion or image delivery unless otherwise agreed in writing.

- Payments are processed through trusted processors (e.g., Stripe, Square, PayPal). You are responsible for any bank/processor fees from your method of payment.

Rescheduling & Cancellations

- One client-initiated reschedule is permitted with 48+ hours notice, subject to availability. Weather or emergency reschedules will be accommodated as reasonably possible.

- If you cancel without rescheduling or miss your session, session fee are forfeited. Additional reschedules require a new session fee.

Client Responsibilities

- Provide accurate contact and session information, arrive on time, and follow location or studio guidelines.

- Secure necessary permissions for locations you request; fees for permits or venue access are your responsibility.

- A parent/guardian must be present for minors during sessions.

Session Conduct & Safety

- We may pause or end a session for safety, harassment, illegal activity, or policy violations. Refunds are not guaranteed in these cases.

- Pets or props are welcome when agreed in advance and when safe for all participants and property.

Image Delivery & Ordering

- Proof galleries/reveals are typically delivered within the timeline stated in your package (commonly 7-14 days for portraits sessions).

- Ordering appointments and product selections must be completed within the stated window in your proposal/contract to keep production on schedule.

- Due to the custom nature of photography and artwork, all product and digital sales are final once delivered/approved.

Editing, Style & Files

- Standard artistic editing consistent with our portfolio is included.

- RAW/unprocessed files are not provided.

- Minor color/brightness variances may occur across devices and print labs; these are not defects.

Usage Rights & Model Release

- You receive a personal-use license for delivered images: you may share with family/friends, and post on personal social media with credit to Blush & Cherish. Commercial use (advertising, brand partnerships, resale) requires a separate written license.

- We may display images for portfolio, website, and marketing purposes. To request an opt-out, email contact@blushandcherish.com prior to your session; reasonable accommodations will be made where permitted by law and contract.

Intellectual Property & Restrictions

- All images remain the copyright of Blush & Cherish. Do not alter with heavy filters, AI generation/recomposition, or sell/transfer rights without written permission.

- Website content (text, graphics) is owned by Blush & Cherish or its licensors; you may not copy or redistribute without consent.

Refunds & Credits

- Session fees are non-refundable. Session fees and product orders are non-refundable once services are rendered or products are ordered.

- If we cannot deliver services due to factors within our control, our liability is limited to amounts you paid for the undelivered portion of the service.

Limitation of Liability

- To the fullest extent permitted by law, Blush & Cherish is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim related to services is capped at the amount you paid for the applicable service.

Indemnification

- You agree to indemnify and hold Blush & Cherish harmless from claims or expenses arising from your breach of these Terms, misuse of the site, or violation of laws/third-party rights.

Changes to These Terms

- We may update these Terms from time to time. Continued use of the site or services after changes are posted constitutes acceptance. Material changes will be noted on this page with the updated date.
